Please read these terms and conditions carefully as they set out the rules for how we run the website and supply the goods which you may purchase through this website. By clicking the “Complete Payment ” button you accept and agree to be bound by these terms and conditions which shall govern the agreement between us.

TERMS & CONDITIONS

Your statutory rights are not affected by these terms and conditions.

Only persons aged eighteen years or over may agree to these terms and use the web site or the services offered through it.

We may modify these terms at any time and they will come into effect as soon as they are posted on the web site.

Payment

MagicalPhotoPix do not offer credit terms and all work carried out must be paid for when ordered. We currently accept payment through PayPal by a range of Credit/Debit Cards or via cheque made payable to ‘Easy2Display Ltd’. If payment is made by cheque it will have to clear before any work is commenced, which may add up to 3-4 days to our estimated delivery date.

Cancelling an Order

Once an order has been paid for we will start production. If you need to cancel an order a 10% administration charge will occur if we have not carried out any associated work or printing. As products have been personalised or customised specifically for you, the customer, once we have commenced the transformation process an order cannot be cancelled or any monies refunded

Returns

We will not accept returns without prior agreement and will only accept returns due to damaged goods logged at receipt and informed to the Couriers. On receipt of the returned goods, we will provide new items and have them delivered to the same address.

Delivery

Delivery costs will vary depending on the final size and destination of the order. This cost will be included in the Total Cost of your order. Delivery will be provided for by Specialist Couriers and they will require for someone to be present to sign for the delivery. It is the sole responsibility of the customer to ensure that someone is available to take delivery and we cannot be held responsible for any late, lost or unforeseeable event caused by a delivery date not being met. You shall be deemed to have accepted the goods after receiving delivery. It is your responsibility to check the delivery before signing for it and we cannot refund any damaged deliveries that have not been logged by the Courier form at the point of delivery.

Colour

Whilst we do endeavour to retain a colour likeness on each transformation, we cannot be held responsible for exact colour matching requirements. Colours may appear differently on your computer screen to ours (due to different monitor settings) and we will not accept returns for colour related issues. If exact colour matching is important then we suggest contacting us to discuss test samples.

Data and Storage Handling

Where we use a third party for the provision of providing some element of the transformation services offered on this website, we acknowledge that, a customer’s photo and/or completed transformations, will be transmitted over the internet or on other data storage medium to our partners, their employees and agents, and may be securely stored for a period of up to two years.

Image Cropping and Gallery Wrapping

For some transformations we may have to crop the photo you send, in order for it to be sized correctly to the size ordered. We will do this with the utmost sensitivity to retain the original feel of the image but we will not be held responsible for cropping out any part of the image. In the unlikely event that cropping interferes with the main subject of the photo we will advise you of this.

If you choose a canvas with part of the image wrapped around the frame ‘gallery style’, please be aware that we need to increase the overall size of the canvas by at least 3 inches, meaning this portion of your photo is wrapped around the edges. If this will affect an important part of the photo, we reserve the right not to ‘gallery wrap’, and instead will print the entire photo on the front of the canvas, and we will inform you of this at the time

Copyright

It is the sole responsibility of the customer to ensure that any image that they present for transformation in any way is copyright free or that the copyright is owned by the customer themselves. We will take no responsibility for any breach of copyright caused through printing an image supplied by a customer.

What you are not allowed to do:

	Upload, e-mail to us or order any images or other material which contain pornographic or obscene material.
	Any racist material.
	Material that is likely to incite hatred against any person or group.
	Blasphemous material.
	Defamatory or otherwise actionable material.
	Images of any criminal act.
	Material the use or inclusion of which infringes any copyright, trademark or other intellectual property right of any third party.
	Material that breaches any applicable laws or legislation.

Law and Jurisdiction

These terms (and the provision of goods and services by us) are governed by and to be interpreted in accordance with English Law. In the event of any dispute arising in relation of these terms or in relation to the provision of any goods and services by us the English courts will have exclusive jurisdiction over such dispute.
